§ 36. [Covenants and restrictions.]

  • At the time of the final plat the developer must submit to the City of Walker a copy of subdivision covenants and restrictions to be recorded. These covenants and restrictions must show the establishment of a homeowner's association with mandatory membership for each property owner and requiring the collection of assessments from members in an amount sufficient to pay for the maintenance of all private improvements. The following note shall be placed on the final plat: "All lots are subject to the Declaration of Covenants and Restrictions filed as an adjunct hereto. The City of Walker does not enforce private deed and/or subdivision restrictions. However the approval of this plat does not release the owner and/or contractor/builder from complying with any such restrictions that may be attached to the property on this plat."
