§ 17-3. Culverts and conduit; permit required.

  • No person shall install, or caused to be installed, within a drainage ditch, channel, canal or public right of way, easement or servitude of drain, any culvert or conduit without first obtaining a permit from the town allowing such installation.

    Upon the request of any person (the "requesting party"), for a permit to install a culvert or conduit within a public drainage ditch, channel, canal or public right of way, easement or servitude of drain, the town shall inspect the location of the proposed installation and shall provide the requesting party with the specifications required for the culvert or conduit to be installed as well as the specifications for installation. Upon the payment by the requesting party of a sum equal to twice the fee required for the necessary permit, based upon a schedule of fees as provided in this section, the town shall issue the requested permit. Depending upon the facts and circumstances attendant to the proposed installation, the town may impose additional conditions upon the issuance of any permit requested pursuant to this provision.

    Upon the completion of the installation of the culvert or conduit, the requesting party shall notify the town, who shall promptly inspect the installation to assure compliance with the specifications for such installation and any conditions imposed upon such installation. Upon a finding that the installation is in compliance with the applicable specifications and conditions, if any, the town shall thereupon return to the requesting party a sum equal to the cost of the permit.
