§ 9-11. Authority of the mayor to control operations of sanitation service.

    The mayor and board of aldermen shall determine the extent to which the city will collect, remove, transport and dispose of waste, garbage and debris within the corporate limits of the city. The mayor shall recommend to the board of aldermen a sanitation service program pursuant to which the city will provide sanitation service. In this regard, the mayor may recommend that the city retain the services of a contractor to provide the city's sanitation service. The board of aldermen may delegate to the mayor the authority to establish rates, fees, charges and assessments to be collected from customers of the city's sanitation service. Absent such delegation of authority, the rates, fees, charges and assessments shall be established by the board of aldermen. Operation of the city's sanitation service shall be the responsibility of the mayor.

    The mayor shall establish, or cause to be established, the city's sanitation service policies which may include a description of the acceptable means of payment, the due date and billing cycles for sanitation service. The mayor, at his discretion, may also establish late charges for the untimely payment of amounts due, charges for NSF checks, reconnection charges and any such other fees, assessments or penalties which may be deemed necessary and appropriate for the efficient operation of the city's sanitation service. Upon establishing the sanitation service policies, and upon any revisions thereto, the mayor shall provide such policies to the board of aldermen. The sanitation service policies may be amended or revised by the mayor, at any time, in the mayor's sole discretion.
